KUThese Terms of Use (“Terms”) govern your use of the Waddledoku iPhone app (the “App”) and waddledoku.com (the “Website”), provided by Xykada LLC (“Xykada,” “we,” “us,” or “our”). By using the App or Website, you agree to these Terms. If you do not agree, do not use them.
Using Waddledoku
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and Website for lawful, non-commercial entertainment. Your use of the iPhone App is also subject to Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”). These Terms supplement the Apple Standard EULA. If these Terms conflict with it regarding your license to the App, the Apple Standard EULA controls.
If you are under the age of legal majority where you live, you may use Waddledoku only with permission from a parent or legal guardian who agrees to these Terms.
Intellectual property and puzzle content
Waddledoku, its artwork, mascot, branding, software, text, puzzle layouts, solution content, and other materials are owned by or licensed to Xykada and protected by intellectual-property laws. You may not copy, sell, publish, scrape, systematically extract, reverse engineer, or create competing materials from them except where applicable law expressly permits it.
User conduct
You may not:
- interfere with or attempt to compromise the App or Website;
- use automated means to overload, scrape, or extract content;
- circumvent access, purchase, advertising, or security controls;
- use Waddledoku to violate law or another person’s rights; or
- misrepresent an unofficial puzzle, answer, or service as ours.
In-app purchases
The App may offer consumable packs of hints and reveals. These items are licensed for use inside Waddledoku, have no cash value, and cannot be transferred. Prices and availability are shown by the App Store before purchase. Apple processes billing and handles refund requests under its policies. Because these items are consumable, Apple does not provide the standard restoration mechanism used for non-consumable purchases; Waddledoku may reconcile an interrupted completed transaction through its purchase provider.
Availability and changes
We may update, suspend, change, or discontinue parts of Waddledoku, including puzzle content, features, optional ads, and purchase offerings. We do not guarantee that the App, Website, Game Center, ads, or third-party services will always be available or error-free.
Disclaimers
To the maximum extent permitted by law, the App, Website, and content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Xykada and its members, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill arising from Waddledoku. Xykada’s total liability for a claim will not exceed the greater of the amount you paid to Xykada for Waddledoku in the twelve months before the claim or US $10. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
Termination
You may stop using Waddledoku at any time. We may suspend or terminate access if you materially violate these Terms or if needed to protect Waddledoku, other users, or legal rights. Provisions that by their nature should survive will survive termination.
Governing law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise. State and federal courts with jurisdiction in Maryland will have jurisdiction over disputes, subject to any rights you have under mandatory local law.
Changes to these Terms
We may revise these Terms as Waddledoku changes. Updated Terms will be posted here with a new effective date. Continued use after the updated Terms take effect means you accept them.
